From 2019 to 2021, we recovered for clients $55,000,000.00.

In September 2022 alone, we recovered $1,350,000 for a cervical fusion injury resulting from a rear end collision, and policy limits of $250,000 for another cervical disc injury for which there was no surgery. Both of these cases were settled in response to our statutory demands prior to the clients having to appear for depositions.

Here are a few illustrative examples of recoveries in cases we handled for clients:

$11,000,000. Amputations. Co-counsel in recovery of combined $11,000,000 for two sisters who suffered below knee amputations in a crash. Confidential settlement.

$9,300,000. Products Liability – Defective Tire. Handled joint damages presentation on behalf of a group of victims in the crash of a college cheerleader van due to a defective tire. All the victims’ families agreed in advance to allocate largest share to a young woman who suffered a permanently disabling brain injury. Total recovery for the group was $9,300,000, of which $1,200,000 was allocated to our client, according to the agreed formula, for the death of her child.

$8,000,000. Truck crash – Wrongful Death. Tractor trailer rear-ended car stopped at red light, killing recent college graduate en route to work. After a year of hard-fought litigation, clients chose to accept $8,000,000 offer of settlement in lieu of going through emotionally painful trial. Confidential settlement.

$6,000,000. Truck crash – Wrongful Death. Co-counsel in truck crash wrongful death with creative theory for imputing liability from small trucking company to larger entity up the food chain. Confidential settlement.

Confidential seven-figure settlement. Products Liability – SUV roof. Roof of SUV crushed in rollover due to inadequate structural integrity, rendering a passenger a quadriplegic. Settled in pre-suit mediation in Florida. Confidential settlement.

$2,900,000 confidential settlement of tractor trailer wrongful death case in small county in South Georgia. The small trucking company had only $1,000,000 insurance coverage, which it offered to split between 3 death claims and multiple injuries. With an innovative legal theory, we brought an additional $10,000,000 insurance coverage to the table and settled in mediation for substantially more than highest verdict in the history of the county. Due to confidential terms of settlement, we cannot reveal more.

$2,345,940.17 jury verdict against trucking company for fractured femur in Superior Court of Gordon County, Calhoun, Georgia. March 9, 2007. Verdict broken down as follows: compensatory damages: $1,742,845.70, attorney fees due to bad faith, $580,948.57, expenses of litigation due to bad faith, $22,145.90. Medical expenses were $112,228. Highest offer from defendant’s insurance company was $400,000 on third day of trial. This was nearly three times the highest previous verdict in the history of Gordon County.

$2,000,000. Products Liability – Forklift Attachment. Recovered insurance policy limits of both manufacturer and distributor of a forklift attachment, in pre-trial settlements after defeating defendant’s motions for summary judgment in wrongful death case. This case was unique in that the claim against the product distributor was the only known case of a wrongful death claim based upon violation of the Georgia Fair Business Practices Act.

$1,900,000. Products Liability – Auto Brakes. Failure of antilock brake system due to interlock between brake fluid sensor and cutoff of ABS led to serious injury and eventual death of teenage passenger in minivan, traveling at high speed en route to basketball game.

$1,750,000. Swimming Pool. Won judgment in favor of toddler injured in swimming pool incident at condominium complex. The 19-month-old child was able to enter closed and locked pool enclosure due to defect in gate latch. The defense argued that the mother’s negligent supervision of her was the sole proximate cause of her child’s injury.

$1,000,000 – Truck Accident – Wrongful Death. Settlement for full insurance policy limits of small trucking company where inattentive trucker ran over family vehicle, killing wife and injuring husband.

Confidential Settlement – Medical Malpractice – Failure to Diagnose Lung Cancer. Workers compensation doctors failed to diagnose lung cancer, or to refer to lung specialist, when chest x-rays suggested existence of lung lesions.

$1,300,000 settlement before trial – Trucking. Settlement of interstate trucking wrongful death case in excess of policy limits prior to trial.

$1,250,000 jury verdict in single car auto crash. Won jury verdict for woman who was passenger in sports car that crashed, resulting in neck, ankle and head injuries. Defense contended that she assumed risk of injury in that she and driver had been drinking and consuming cocaine together for some time before getting in the car.

$850,000 settlement during jury deliberation. Rear end collision by 18-wheeler resulted in aggravation of pre-existing degenerative condition of spine, with eventual cervical fusion surgery. Case was tried three days in State Court of Bibb County and settled during jury deliberation.

$750,000. Hospital Malpractice. Recovery from hospital outside metro Atlanta for child injured by a misplaced IV needle.

$625,000 truck wreck settlement. Concrete truck overturned on family vehicle, resulting in closed head injury to child. All physicians reported a good medical recovery but concerns about potential future problems lingered. Structured settlement provided down payment on new home in which to raise the child, learning support services through high school, and annuity providing for post-secondary college or vocational training, monthly income for life, and very substantial increments of cash every five years to age 50.

$500,000. Products Liability – Poultry Processing Equipment. Recovery against manufacturer and installer of poultry processing equipment on behalf of poultry inspector who developed an invisible reflex sympathetic dystrophy struck by a flying shackle slung off conveyor line.

$425,000. Auto collision. Recovery against “gig economy” driver for elderly woman injured in collision. Confidential settlement.

$300,000. Tire explosion. Confidential settlement for tire shop owner with scarring from injury when defective tire exploding during mounting.

$250,000. Motorcycle-pedestrian collision. Recovered for motorcyclist against pedestrian who jogged out in front of him.

$245,000. Products Liability – Carpet Manufacturing Equipment. Recovery from manufacturer of carpet mill machinery on behalf of worker whose hand was crushed in rollers on direct coating applicator. He had bad soft tissue injuries to hand but no broken bones. Defense argued that hazard was open and obvious, and that training was to retrieve debris from latex puddle with a tool rather than by hand.
